The State revealed that despite concerns being raised on irregular spending by controversial Durban businessman Thoshan Panday in 2010, former KwaZulu-Natal police commissioner Mmamonnye Ngobeni failed to report the alleged tender fraud.
She appeared in court on Monday.
Ngobeni, Panday, Navin Madhoe, and Aswin Narainpershad are accused of manipulating tender processes during the 2010 Fifa World Cup.
Supply chain management procedures were allegedly manipulated in favour of Panday.
They are facing charges of fraud, corruption, extortion, and forgery.
According to the State, Panday’s businesses gained R47 million in 2010 from the corrupt dealings.
A charge sheet showed that Ngobeni stopped a senior finance official from conducting investigations into expenditure related to Panday’s businesses.
This was after the official raised concern that the police was being overcharged by Panday, who at some point added a 300% mark-up on products and services.
Meanwhile, Ngobeni’s lawyer claimed that the charges against her were unconstitutional because the former KZN National Prosecuting Authority (NPA) head Moipone Noko refused to prosecute her in 2014.
