It has been revealed that Cassper Nyovest does not own the trademark #FillUp in South Africa. The rapper cried out on social media this week over the usage of #FillUp by Tsonga singer Benny Mayengani, for his recently concluded gig and in fact threatened to sue him. The matter attracted the attention of politician Julius Malema.
According to an investigation carried out by TshisaLive, Cassper has not been granted the right over the said trademark. The publication confirms that Cassper Nyovest indeed applied for ownership of the copyright in 2016 using his real name but the Companies and Intellectual Property Commission (CIPC) gave him terms and condition to which the trademark will be granted but that has not been met as at the time Benny used it.
“The office has issued an official action setting out the conditions for acceptance of the application. The trademark applicant needs to respond in writing to the office agreeing to the conditions in order for the application to proceed to acceptance‚” senior manager at CIPC’s Head Of Trademarks Division Fleurette Coetzee explained to TshisaLIVE.
