Convicted criminal and Nelson Mandela Bay councillor – Andile Lungisa has withdrawn his statement casting defamation on the impartiality of the Supreme Court of Appeal (SCA) judges who were on his assault case.


Lungisa is currently ongoing a two-year jail sentence at a prison in Grahamstown, after he laid assault on a DA councillor with a glass jug in 2016.

He is tendering an appeal for his sentence in the Constitutional Court, but has decided to stay behind bars after the court granted him bail.

In September when he came before the court, Lungisa allegedly mentioned his case was not decided on a fair ground because of the political and familial connections of the judges.

The judges requested for a retraction of his comment or should make provision of proof to defend his allegations.

In a statement, the councillor withdrew his remarks and admitted they were not found.

Unfortunately, Mr Lungisa is still incarcerated and there is no time to go around and gather all the information about the validity of those claims. Because of that and because he has a good relationship with the country and the constitution, than his own ego, he has decided to withdraw,” Mosase said.
